These Terms and Conditions ("Terms") govern all photography, videography, drone, floor plan, virtual tour, and related real estate media services provided by Coastal Living Photography ("CLP," "we," "us," or "our"), a Florida-based real estate media company. By booking, commissioning, downloading, or using any media produced by CLP, the client ("Client," "you," or "your") agrees to these Terms.
1. Services
CLP provides professional real estate photography and media services, including but not limited to still photography, aerial/drone photography and video, floor plans, virtual tours, and custom property web pages (collectively, "Media"). Services are provided pursuant to the booking confirmation and package selected by the Client.
2. Copyright and Ownership
All Media produced by CLP are protected under United States Copyright Law (17 U.S.C. § 101 et seq.).
• CLP retains full and exclusive copyright ownership of all Media at all times.
• No copyright is transferred to the Client unless expressly agreed to in writing and signed by CLP.
• Any rights granted to the Client are strictly licensed rights, not a sale of the Media.
3. Standard License (Included Use)
Unless otherwise stated in writing, CLP grants the Client a limited, non-exclusive, non-transferable license to use the Media solely for:
• Marketing the specific property photographed
• MLS listings and MLS-affiliated websites (including IDX feeds)
• Realtor and brokerage websites
• Print marketing directly related to the property
• Social media marketing of the property
This license:
• Applies only to the listing period of the photographed property
• Automatically terminates upon sale, lease, withdrawal, or expiration of the listing
• Is valid only for the listing agent and brokerage of record
• Does not transfer to subsequent agents, homeowners, builders, developers, stagers, designers, or other third parties
Use of the Media must comply with applicable MLS rules, MLS subscriber agreements, and brokerage compliance policies.
4. Extended Use License (Optional / Additional Fee)
Any use beyond the Standard License requires an Extended Use License, which must be purchased separately.
Extended Use includes, but is not limited to:
• Portfolio use beyond the active listing period
• Ongoing branding or evergreen marketing
• Builder, developer, or community-wide marketing
• Print ads, billboards, magazines, or large-format signage
• Transfer or sublicensing to third parties (including sellers, builders, or designers)
Extended Use is not granted automatically and is valid only if explicitly approved in writing by CLP and paid in full.
4A. Relisting / Agent Change Provision
We understand that listings sometimes change hands.
• If a property is relisted with a different agent or brokerage, the original license does not transfer automatically
• The new agent or brokerage must obtain a new license from CLP before using the Media
• The original listing agent may continue to use the Media only while they are the active listing agent
To keep things simple, CLP offers relisting licenses at a reduced rate when the same property and existing Media are reused.
5. Prohibited Uses
The Client may not, under any circumstances:
• Sell, sublicense, assign, or transfer the Media to any third party without written consent
• Allow reuse of the Media by another agent, team, or brokerage without an Extended Use License
• Use the Media for properties other than the one originally photographed
• Alter, composite, or heavily manipulate the Media in a way that misrepresents the property
• Remove metadata, watermarks, or copyright notices
• Claim authorship or copyright ownership of the Media
Any MLS-required resizing, cropping, or minor adjustments that do not materially alter the Media are permitted.
6. Artificial Intelligence (AI) Use Prohibition
Strictly prohibited:
The Media may not be used for any artificial intelligence or machine learning purposes, including but not limited to:
• Training AI models
• Feeding datasets for generative AI systems
• Creating AI-generated marketing materials
• Image synthesis, style transfer, or automated derivative works
• Uploading to any platform or software that uses content for AI training or algorithmic learning
This prohibition applies regardless of whether the AI use is commercial, internal, experimental, or promotional. Any AI-related use requires prior written consent from CLP and may involve additional licensing fees.
7. Drone and Aerial Services
All drone operations are conducted in compliance with FAA Part 107 regulations.
• CLP operates drones only when conditions are legal, safe, and permissible
• Weather, airspace restrictions, TFRs, or FAA limitations may require modification or cancellation of aerial services
• No guarantees are made regarding specific angles, altitudes, or compositions
• Refunds for drone services are limited to the drone portion of the booking if flight is not legally possible
The Client represents that they have authority to permit aerial photography of the property and acknowledges that CLP is not responsible for third-party objections or restrictions.
8. Client Responsibilities
The Client is responsible for:
• Ensuring the property is prepared and ready at the scheduled time
• Securing permissions from property owners, HOAs, or governing bodies
• Confirming accuracy of listing details and property representations
CLP is not responsible for delays or reshoots due to unprepared properties.
9. Payment Terms
• Payment terms are as agreed at booking
• Media will not be released until payment obligations are satisfied, unless otherwise stated
• Late payments may result in license revocation and additional fees
Failure to remit payment may result in collection actions, late fees, and suspension of future services.
10. Limitation of Liability
To the maximum extent permitted under Florida law:
• CLP’s liability is limited to the amount paid for the specific service
• CLP is not liable for indirect, incidental, or consequential damages
• CLP does not guarantee sale, lease, or performance outcomes
11. Indemnification
The Client agrees to indemnify and hold harmless CLP from any claims, damages, or liabilities arising from:
• Unauthorized use of the Media
• Violations of these Terms
• Client misrepresentations or third-party disputes
12. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in a court of competent jurisdiction in Florida.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Acceptance
Booking services, downloading Media, or using any Media constitutes acceptance of these Terms in full.

Good to know:
• If a listing changes agents, the new agent just needs their own license
• Extended or relisting licenses are available and usually discounted

Terms and Conditions – Rental Property Media

These Terms and Conditions ("Terms") govern all photography, videography, drone, and related media services provided by Coastal Living Photography ("CLP," "we," "us," or "our") for rental properties, including vacation rentals, short-term rentals (STR), long-term rentals, and listings on platforms such as Airbnb and VRBO.
By booking, purchasing, downloading, or using any media produced by CLP, the client ("Client," "you," or "your") agrees to these Terms.
1. Scope of Services
CLP provides professional real estate media services, including but not limited to still photography, aerial/drone imagery, video, and virtual tours (collectively, "Media"). Services are delivered based on the package selected at booking.
2. Copyright Ownership
All Media created by CLP are protected under United States Copyright Law.
CLP retains full and exclusive copyright ownership of all Media
No copyright is transferred to the Client
The Client receives a license to use the Media as outlined below
3. Rental Use License (Included Use)
CLP grants the Client a non-exclusive, non-transferable license to use the Media for marketing and promoting the specific rental property photographed.
Permitted uses include:
Vacation rental listings (Airbnb, VRBO, direct booking sites, etc.)
Property management websites
Long-term rental listings and advertising
Social media and digital marketing for the rental
Print marketing directly related to the rental property
This license:
Remains valid as long as the Client retains ownership or management control of the property
Is limited to the specific property photographed
Applies only to the Client (owner or property manager of record)
4. Ownership Change / Transfer of Rights
If ownership of the property changes:
The license automatically terminates upon transfer of ownership
The new owner or manager must obtain a new license from CLP to use the Media
If property management changes:
The license does not automatically transfer to a new property manager
A new license must be obtained, though discounted transfer licenses may be available
5. Extended and Commercial Use
Any use beyond standard rental marketing requires an Extended Use License, including but not limited to:
Brand-wide or portfolio marketing unrelated to the specific property
Commercial advertising campaigns beyond the rental listing
Use by third parties such as designers, builders, or tourism boards
Extended use must be approved in writing and may require additional fees.
6. Prohibited Uses
The Client may not:
Sell, sublicense, or distribute the Media to third parties without permission
Allow use of the Media by another property or listing
Use the Media after ownership or management rights end
Claim authorship or copyright ownership
Use the Media in a misleading, deceptive, or unlawful manner
7. Artificial Intelligence (AI) Restrictions
The Media may not be used for:
Training artificial intelligence or machine learning models
Generating AI-based marketing content or derivative works
Uploading to platforms that use content for AI training
Any AI-related use requires prior written approval from CLP.
8. Drone and Aerial Media
All drone operations are conducted in accordance with FAA regulations.
Flights are subject to weather, safety, and airspace restrictions
CLP reserves the right to modify or cancel drone services if conditions are not compliant
No guarantee is made regarding specific aerial compositions
9. Client Responsibilities
The Client is responsible for:
Ensuring the property is clean, staged, and ready at the time of the shoot
Securing all necessary permissions for photography
Ensuring listing accuracy and proper representation of the property
10. Payment Terms
Payment is due as agreed at booking
Media delivery may be withheld until payment is received
Late payments may result in fees and/or suspension of license rights
11. Use by CLP (Portfolio & Marketing)
CLP retains the right to use all Media for:
Portfolio display
Website and social media marketing
Advertising and promotional materials
Industry competitions and publications
This use does not require additional consent or compensation to the Client.
12. Limitation of Liability
To the maximum extent permitted by law:
CLP’s liability is limited to the amount paid for services
CLP is not responsible for business performance, bookings, or rental income
CLP is not liable for indirect or consequential damages
13. Governing Law
These Terms are governed by the laws of the State of Florida.
14. Acceptance
Use of the Media constitutes full acceptance of these Terms.
